Kedroski and his lawyer, Ann O'Connell, assert that state law requires the city, as his employer, to pay the entire premium of his city health insurance plan for the firefighter, his spouse and for each of his dependant children. His two children are under the age of 18. The lawsuit also points out the fact that the Des Plaines Firefighters Pension Fund Board awarded Kedroski a line-of-duty disability pension, said John Q. Kelly, a New York catastrophic injury lawyer.
"Because the drill was required training for an actual emergency, Kedroski was reasonable to believe that he was faced with an emergency," the lawsuit says. It also says that the city has refused to pay the insurance premiums after City Manager Jason Bajor was asked to do so. Kedroski is asking the city to pay for his insurance premiums, reimburse him for insurance costs he has incurred since the time of the injury and pay reasonable attorneys fees and costs.
